1. Overview
The Home Loan Referral Rewards Program ("Program") by 45COMAN PTY LTD T/A FINSEEK ("Finseek", "we", "us") allows Businesses ("Referrer", "you") to earn rewards by referring clients to Finseek for home loans, refinancing, or home improvement loans. These Terms and Conditions ("T&Cs") govern your participation in the Program and form a legally binding agreement between you and Finseek.
2. Eligibility
2.1 Referrer Eligibility:
- You must be operating in Australia, aged 18 or older, and have a valid Australian Business Number (ABN) or be a sole trader/freelancer.
- You must not be a licensed credit provider, mortgage broker, or financial adviser, as this Program is for "spot and refer" activities only under the NCCP Act.
- Finseek reserves the right to approve or reject Referrers at its discretion.
2.2 Referred Client Eligibility:
- Referred clients must be Australian residents aged 18 or older seeking a home loan, refinancing, or home improvement loan.
- The referred loan must meet Finseek’s minimum criteria: a loan amount of $450,000 or more, subject to lender approval.
- The referred client must not already be an existing client of Finseek at the time of referral.
3. Referral Process
3.1 How to Refer:
- Sign up for the Program at https://finseek.com.au/join-referral to receive a unique referral link or code.
- Share your unique referral link with potential clients, or submit their details (name, phone, email) via the referral form on our website.
- Referred clients must mention your name or use your referral link/code when contacting Finseek.
3.2 Referral Tracking:
- Finseek will track referrals using your unique link/code or the submitted client details.
- Referrals not linked to your unique identifier will not be eligible for rewards.
3.3 Finseek’s Role:
- Finseek will contact the referred client, assess their loan needs, and facilitate the loan application process with one of our 60+ partner lenders.
- You may contact Finseek at any time for updates on the referral’s progress.
4. Rewards
4.1 Standard Reward:
- You will earn $150 per referred client whose loan settles with a lender through Finseek, provided the loan amount is $450,000 or more.
- Payment will be made within 45 days of loan settlement via bank transfer or eGift card (your choice).
4.2 Tiered Bonuses:
- If you refer 3 or more clients whose loans settle in a single calendar month, you will earn the following bonuses:
- 3 referrals: $400 total ($150 x 3 = $450, minus $150 standard, plus $100 bonus).
- 5 referrals: $800 total ($150 x 5 = $750, plus $50 bonus).
- Bonuses are paid with the standard reward within 30 days of the last loan settlement in the month.
4.3 Sign-Up Bonus:
- If you join the Program by May 22, 2025, and make your first referral within 30 days of signing up, you will receive a $50 eGift card after the first referred loan settles.
- This bonus is a one-time offer and will be paid with the standard reward for the first settled loan.
4.4 Reward Conditions:
- Rewards are only payable if the referred loan settles and remains active for at least 30 days (i.e., not cancelled or refinanced elsewhere within 30 days).
- Finseek reserves the right to withhold or reclaim rewards if the referral is found to be fraudulent, non-compliant, or if the loan is cancelled within 30 days of settlement.
5. Referrer Obligations
5.1 Compliance with NCCP Act:
- You must only “spot and refer” clients to Finseek without providing credit advice or assistance (e.g., recommending loan products, comparing rates). Providing credit advice without a license violates the NCCP Act and may result in your removal from the Program.
- You must disclose to clients that you may receive a reward for the referral, as required by ASIC’s best interest duty guidelines.
5.2 Client Consent:
- You must obtain the client’s consent to share their personal details (name, phone, email) with Finseek, in compliance with the Australian Privacy Principles (APP) under the Privacy Act 1988.
- You must not share client details without consent, and Finseek will not be liable for any breaches of privacy laws by the Referrer.
5.3 Accurate Information:
- You must provide accurate client details to Finseek. Providing false or misleading information may result in disqualification from the Program.
5.4 Professional Conduct:
- You must not engage in spamming, unsolicited marketing, or any conduct that harms Finseek’s reputation when promoting the Program. Violation may lead to termination of your participation.
6. Finseek’s Obligations
6.1 Loan Facilitation:
- Finseek will act in the best interests of referred clients, comparing loans from 60+ lenders to find the best rates, in line with ASIC’s best interest duty.
- Finseek will disclose to clients that we earn commissions from lenders, ensuring transparency as required by the NCCP Act.
6.2 Reward Payment:
- Finseek will pay rewards within 45 days of loan settlement, provided all conditions are met.
- Finseek will notify you of the loan settlement and reward payment status via email.
6.3 Data Protection:
- Finseek will handle client data in accordance with the Privacy Act 1988 and APP, ensuring confidentiality and security.
- Finseek will not share your personal details with third parties without your consent, except as required by law.
7. Program Duration and Termination
7.1 Program Duration:
- The Program is ongoing but may be modified or terminated by Finseek at any time with 30 days’ written notice via email or on our website.
- The sign-up bonus ($50 eGift card) is available only to Referrers who join by May 22, 2025, and make their first referral within 30 days.
7.2 Termination by Finseek:
- Finseek may terminate your participation immediately if you:
- Breach these T&Cs, including NCCP Act obligations.
- Engage in fraudulent or unethical behavior.
- Fail to comply with privacy laws or engage in spamming.
- Upon termination, you will forfeit any unpaid rewards.
7.3 Termination by Referrer:
- You may withdraw from the Program at any time by notifying Finseek in writing at admin@finseek.com.au. You will be paid for any eligible referrals that settle within 30 days of your withdrawal.
8. Liability and Indemnity
8.1 Limitation of Liability:
- Finseek is not liable for any loss, damage, or expense you incur as a result of participating in the Program, including but not limited to lost profits or reputational damage.
- Finseek does not guarantee that referred clients will qualify for a loan or that loans will settle, as this depends on lender criteria and client circumstances.
8.2 Indemnity:
- You agree to indemnify Finseek against any claims, losses, or damages arising from your breach of these T&Cs, including non-compliance with the NCCP Act, Privacy Act, or Spam Act 2003.
9. Privacy and Data Protection
9.1 Collection of Data:
- Finseek collects your personal information (e.g., name, email, ABN) to administer the Program and pay rewards, in compliance with the Privacy Act 1988.
- Client data (e.g., name, phone, email) will be used solely to contact them for loan services and will not be shared with third parties except as required by law or with consent.
9.2 Your Rights:

10. Compliance with Australian Laws
10.1 NCCP Act and ASIC:
- Finseek operates under the NCCP Act and adheres to ASIC’s best interest duty, ensuring transparency and fairness in all loan dealings.
- Referrers must comply with NCCP Act exemptions for “spot and refer” activities, avoiding credit advice or assistance.
10.2 Spam Act 2003:
- Finseek’s emails comply with the Spam Act 2003, including providing an unsubscribe option. Referrers must not use spamming techniques to promote the Program.
10.3 Australian Consumer Law (ACL):
- Rewards and bonuses are genuine and time-limited as stated. Finseek will not engage in misleading or deceptive conduct, ensuring compliance with the ACL.
11. Dispute Resolution
11.1 Resolution Process:
- Any disputes arising from the Program will be addressed through good-faith negotiation between you and Finseek.
- If unresolved, disputes will be referred to mediation in [City, e.g., Sydney], Australia, before proceeding to legal action.
11.2 Governing Law:
- These T&Cs are governed by the laws of [State, e.g., New South Wales], Australia. Any legal proceedings will be conducted in the courts of [State].
12. Miscellaneous

- Rewards may be considered taxable income. You are responsible for reporting rewards to the Australian Taxation Office (ATO) and paying any applicable taxes. Finseek will provide payment summaries for tax purposes upon request.
12.3 Entire Agreement:
- These T&Cs constitute the entire agreement between you and Finseek regarding the Program, superseding any prior agreements or understandings.
